This paper aims to analyze the rights of nature as an argument in climate litigation. The rights of nature represent a theoretical and normative proposal seeking an alternative solution to the 21st-century environmental and climate crisis. Thus, these would not be climate litigation based on human rights, but rather on the rights of nature. The article argues that there is growing evidence that this approach is beginning to be used to develop a type of climate litigation within international and comparative jurisprudence.
