Abstract

The article systematizes the jurisprudence of the Inter-American Court of Human Rights on Article 26 of the American Convention and discusses the different approaches of the court to consider violations of economic, social, cultural, and environmental rights. It also highlights the most relevant aspects of the Inter-American Court of Human Rights jurisprudence for domestic law and for the consideration of national judges in Latin America. For this, based on selected cases, an analysis is carried out of the interpretative criteria used by the court to understand the scope of these rights and assess their compliance.
