The right to adequate clothing in the International Covenant of Economic, Social and Cultural Rights: Exploration of its state and approximation to its content

Abstract

The right to adequate clothing can be found in several international human rights treaties, including the International Covenant on Economic, Social and Cultural Rights. The attention that has been devoted to this right since its consecration, however, is scarce. The consequence of this is a profound ignorance about its content, which is not consistent with how important clothing is in the lives of people. Attempting to contribute to the solution of this problem, this work compiles the sources of this right in international human rights law, reviews the treatment of this right by the Committee on Economic, Social and Cultural Rights and other organs of the universal human rights protection system, as well as the existing doctrine on the matter; analyzes the importance of clothing considering the functions it fulfills, offers an interpretation of the right to adequate clothing and an approach to its content according to its formulation in the aforementioned Covenant, and offers a framework to determine the nature of its relation with other human rights. The crucial importance of this right will be evidenced, meriting further investigation.
