This work addresses two serious problems in the protection of human rights of people in human mobility contexts in Chile: one linked to the migrant popula-tion and another to people seeking refuge. In the first case, the absence of minimum procedural guarantees (due process) in deportation proceedings is analyzed, as well as the lack of motivation for decisions by the immigration authority. For the second, the problems of access to the procedure for qualifying refugee status generated by the State Administration itself are examined, to prevent the exercise of this right. For both cases, the standards of international human rights law that are fully applicable to the State of Chile are developed, realizing how the national courts have had to take charge of this situation through the constitutional actions of habeas corpus and protection.
