Due process and women’s access to justice: Inter-american standards and feminist contributions

Abstract

This article analyzes the impact of incorporating a gender approach in procedural law, highlighting how procedural rules and practices, traditionally considered neutral, can become obstacles to women's access to justice. Based on a bibliographic review of academic databases and official documents, three key aspects are examined: feminist critiques of procedural law, Inter-American standards on due process and gender, and best practices implemented to reduce barriers in the justice system. The analysis emphasizes the rules derived from the standards of the Inter-American Human Rights System, as well as national tools such as the guide developed by the Gender Commission of the Colombian Judicial Power.
